Jeffrey Skatoff successfully settled a Federal trust contest case in the Southern District of Florida on behalf of the daughter and grandchildren of a deceased resident of Florida, brought suit in Federal District Court for the Southern District of Florida to challenge a trust amendment to a revocable trust.
Various procedural challenges were overcome during the litigation, including whether or not all trust beneficiaries who might be affected by the litigation needed to be joined as indispensable parties. The trust amendment that was challenged was done late in the decedent’s life, after serious illness, which gave rise to the grounds for the challenge. After an all-day mediation, the parties reached a settlement that was beneficial to all parties in the litigation.
